Qu\u00e9 miedo. \u00bfSer\u00e1 \u00e9sta la nueva Justicia sin rostro?<span>\u00a0<\/span><strong>\u00bfPodr\u00e1 un implacable sistema autom\u00e1tico reemplazar a abogados, fiscales y jueces?<\/strong><!--more--><\/p>\n<p>Las Naciones Unidas debaten estos futuribles ahora, en la<span>\u00a0<\/span><strong>Cumbre Mundial de Inteligencia Artificial para el Bien.<\/strong><span>\u00a0<\/span>Convocaron al Dr. Juan G. Corval\u00e1n (director del Laboratorio de Inteligencia Artificial de la UBA y de la diplomatura Derecho 4.0 de la Universidad Austral).<strong><span>\u00a0<\/span>Se presenta Prometea, el sistema legal predictivo del Ministerio P\u00fablico Fiscal de la Ciudad de Buenos Aires, l\u00edder en Am\u00e9rica Latina.<\/strong><span>\u00a0<\/span>Resuelve casos judiciales con aciertos del<span>\u00a0<\/span><strong>96%.<\/strong>Elabora<span>\u00a0<\/span><strong>1.000 dict\u00e1menes en 45 d\u00edas.<\/strong><span>\u00a0<\/span>La innovaci\u00f3n en el Derecho ya lleg\u00f3. Y nos abre mil preguntas.<\/p>\n<p>En la Justicia, en las \u00e1reas legales de las empresas, en los estudios jur\u00eddicos: \u00bfpodemos automatizar las soluciones legales? \u00bfQu\u00e9 actividades automatizar y cu\u00e1les no? \u00bfCu\u00e1l ser\u00e1 el impacto? \u00bfPodemos esperar?<\/p>\n<p>Ya no hay marcha atr\u00e1s. Es hora de incorporar la inform\u00e1tica a pleno, con sensibilidad jur\u00eddica, para que las decisiones legales sean m\u00e1s eficientes y r\u00e1pidas, analizadas con mayor finura.<span>\u00a0<\/span><strong>Las herramientas de inteligencia artificial no reemplazan a la abogac\u00eda, facilitan volver a pensar el Derecho en la Era del cambio.<\/strong><\/p>\n<p>El universo legal se apeg\u00f3 a los formalismos y los procedimientos. Muchos han perdido sentido y no mejoran la decisi\u00f3n. La inteligencia artificial, bien implementada, les devuelve a las \u00e1reas legales la oportunidad de pensar lo jur\u00eddico, lo que las diferencia, dejando en manos de la m\u00e1quina lo mec\u00e1nico.<\/p>\n<p>Pregunt\u00e9monos qu\u00e9 es lo intr\u00ednseco de ser abogado, para identificar lo esencial. El profesor de la Yale Law School, Anthony Kronnam (\u201cVivir en el Derecho\u201d), advierte que un abogado no s\u00f3lo posee conocimientos o habilidades, sino que debe desarrollar el talento para estudiar todas las alternativas con desapego para tomar la decisi\u00f3n correcta. El buen abogado no se define por cu\u00e1nto sabe o por su destreza argumentativa sino<span>\u00a0<\/span><strong>por la sensatez con la cual analiza y decide.<\/strong><\/p>\n<p>Hoy alcanzar el ideal de Kronnam parece<span>\u00a0<\/span><strong>ut\u00f3pico.<\/strong><span>\u00a0<\/span>Porque la informaci\u00f3n no fluye, no se cuenta al instante con los datos jur\u00eddicos y f\u00e1cticos necesarios. La categorizaci\u00f3n de la informaci\u00f3n consume los tiempos y empobrece la decisi\u00f3n. Ni cabe la simulaci\u00f3n de alternativas antes de cada toma de decisi\u00f3n.<\/p>\n<p>En la Era del cambio se redefinen las profesiones. Tambi\u00e9n las jur\u00eddicas.<strong><span>\u00a0<\/span>El abogado 4.0 se vale de todas las herramientas tecnol\u00f3gicas<\/strong>, se mete en el coraz\u00f3n de las organizaciones. Incorporaron la Inteligencia Artificial en la producci\u00f3n o lo comercial. Pero les falta a\u00f1adir un escal\u00f3n, las \u00e1reas legales, m\u00e1s conceptuales y valorativas,<span>\u00a0<\/span><strong>no para reemplazar las decisiones, para hacerlas posibles.<\/strong><\/p>\n<p>Enfrentemos la innovaci\u00f3n. Debemos analizar los conflictos emergentes de la aplicaci\u00f3n de algoritmos o sistemas de inteligencia artificial. Pero lo m\u00e1s importante, donde seremos irreemplazables, ser\u00e1 en su dise\u00f1o, puesta a punto y revisi\u00f3n, para asegurar su sustentabilidad jur\u00eddica a largo plazo, entendiendo su din\u00e1mica y evoluci\u00f3n. Se trata de pensar, con inteligencia previa y<strong><span>\u00a0<\/span>sentido de lo jur\u00eddico<\/strong>, cada nuevo proceso de inteligencia artificial.
