{"id":18060,"date":"2019-08-29T08:59:54","date_gmt":"2019-08-29T14:59:54","guid":{"rendered":"http:\/\/otech.uaeh.edu.mx\/noti\/?p=18060"},"modified":"2019-08-29T09:00:46","modified_gmt":"2019-08-29T15:00:46","slug":"voluntad-o-tecnologia","status":"publish","type":"post","link":"https:\/\/otech.uaeh.edu.mx\/noti\/tech\/voluntad-o-tecnologia\/","title":{"rendered":"\u00bfVoluntad o tecnolog\u00eda?"},"content":{"rendered":"<p>En d\u00edas recientes el presidente electo, Alejandro\u00a0Giammattei, propuso crear una Comisi\u00f3n Anticorrupci\u00f3n\u00a0a la que se le podr\u00edan asignar hasta Q75 millones para su funcionamiento. Seg\u00fan\u00a0Giammattei, dicha propuesta ya contaba con la aceptaci\u00f3n del gobierno estadounidense. \u00a0Adem\u00e1s\u00a0asegur\u00f3 que los fondos saldr\u00edan de la reestructuraci\u00f3n de varias dependencias del Ejecutivo, as\u00ed como del apoyo de pa\u00edses donantes y dem\u00e1s organismos internacionales.<!--more--><\/p>\n<p>Algunos consideran que el problema de crear una Comisi\u00f3n\u00a0de este tipo,\u00a0radica en que si podr\u00e1 ser independiente de los \u201cpoderes f\u00e1cticos\u201d, hay quienes consideran que el problema radica en que no tendr\u00e1 autonom\u00eda presupuestaria y eso la debilitar\u00e1, otros\u00a0dudan que sea una Comisi\u00f3n lo suficientemente \u201cinclusiva\u201d para elaborar los planes de acci\u00f3n.<\/p>\n<p><span>Sin embargo, considero que se est\u00e1 obviando el tema de si realmente es necesaria, y de serlo, cu\u00e1les ser\u00edan sus funciones y por cu\u00e1nto tiempo estar\u00eda funcionando. \u00a0Cuando cuestiono la necesidad de la Comisi\u00f3n, no cuestiono el combate a la corrupci\u00f3n sino los mecanismos para combatirla.<\/span><\/p>\n<p>De ah\u00ed la relevancia de la respuesta a la pregunta \u00bfpara combatir la corrupci\u00f3n se necesita tecnolog\u00eda o voluntad pol\u00edtica? \u00a0Posiblemente haga falta una mezcla de ambas, en especial de esta \u00faltima cuando se inicie\u00a0el proceso de desmantelamiento de estructuras delincuenciales dentro del gobierno.<\/p>\n<p>Como explicaba en mi anterior art\u00edculo, \u201ces importante comprender que\u00a0<a href=\"https:\/\/republica.gt\/2017\/09\/12\/quiere-combatir-la-corrupcion\/\">la lucha contra la corrupci\u00f3n<\/a>\u00a0tiene dos componentes. El primero es perseguir, enjuiciar y encarcelar a los pol\u00edticos corruptos o extorsionistas, as\u00ed como a sus c\u00f3mplices.\u201d\u00a0\u00a0Esta es una acci\u00f3n reactiva, es decir, corresponde a la persecuci\u00f3n de corruptos\u00a0y\u00a0es\u00a0principalmente\u00a0el Ministerio P\u00fablico \u00a0qui\u00e9n realiza la investigaci\u00f3n. Esta es la parte tecnol\u00f3gica donde los investigadores deben realizar\u00a0muy\u00a0bien su trabajo, sustentar las\u00a0investigaciones\u00a0con pruebas cient\u00edficas que permitan presentar casos s\u00f3lidos y,\u00a0por consiguiente, dif\u00edciles de perder.<\/p>\n<p>Para esto, se necesita tener al personal capacitado as\u00ed como los insumos y equipo necesarios para dicha tarea. \u00a0Como indicaba, \u00e9ste es s\u00f3lo un componente del combate a la corrupci\u00f3n que debe ir acompa\u00f1ado de un\u00a0Organismo Judicial\u00a0que emita\u00a0sentencias apegadas a Derecho.\u00a0Este componente, el de perseguir corruptos,\u00a0es\u00a0importante por lo que se debe continuar.<\/p>\n<p>El\u00a0segundo\u00a0componente es preventivo y consiste en\u00a0atacar el origen de la corrupci\u00f3n, el poder burocr\u00e1tico discrecional. \u00a0Este poder, a veces arbitrario, permite a los pol\u00edticos y\u00a0dem\u00e1s bur\u00f3cratas abusar del mismo para extorsionar a los ciudadanos que requieren de sus permisos o licencias para operar, para obtener contratos del Estado, o\u00a0el\u00a0pago de\u00a0esos\u00a0contratos. \u00a0Al tener el poder de otorgar privilegios, \u201cacelerar\u201d tr\u00e1mites\u00a0o asignar contratos, hace que puedan extorsionar a quienes hagan \u201cnegociaciones\u201d con ellos o, \u00a0buscar coludirse con estos bur\u00f3cratas para saquear los impuestos pagados por los tributarios.<\/p>\n<p>Reducir al m\u00e1ximo el\u00a0poder\u00a0arbitrario\u00a0de los bur\u00f3cratas, eliminar tr\u00e1mites innecesarios, reducir la tramitolog\u00eda y limitar al m\u00e1ximo\u00a0<a href=\"https:\/\/republica.gt\/2018\/05\/22\/criterio-de-ventanilla\/\">el criterio de ventanilla<\/a>\u00a0podr\u00edan ser el principio de cambios m\u00e1s profundos como la duplicidad de funciones con el respectivo exceso de personal.<\/p>\n<p>La pregunta sigue en el aire \u00bfes necesaria una Comisi\u00f3n contra la corrupci\u00f3n para combatirla? \u00bfO simplemente es falta de tecnolog\u00eda o de voluntad pol\u00edtica?<\/p>\n<p><strong>Fuente:\u00a0<\/strong><\/p>\n<p><em>Maria Dolores Arias, M.
